Terms and Conditions
1. General
By booking a tour or safari package with us, you confirm that you have read, understood, and agreed to the following terms and conditions. These terms form the basis of your contract with us and apply to all bookings made through our website, by email, or by phone.
2. Bookings & Confirmation
All bookings are subject to availability. A booking is confirmed only upon receipt of a deposit and a written confirmation from us. We reserve the right to decline any booking at our discretion.
3. Deposits & Payments
A non-refundable deposit of 30% of the total tour cost is required to secure your booking. The remaining balance is due 30 days prior to the departure date. For bookings made within 30 days of departure, full payment is required at the time of booking. Payments can be made by bank transfer, credit card, or such other methods as we may specify.
4. Cancellations by the Client
All cancellations must be made in writing. The following cancellation charges apply:
More than 60 days before departure — loss of deposit only
30–60 days before departure — 50% of total tour cost
15–29 days before departure — 75% of total tour cost
14 days or less before departure — 100% of total tour cost
5. Cancellations & Changes by the Company
We reserve the right to cancel or modify any tour due to circumstances beyond our control, including but not limited to natural disasters, political instability, adverse weather conditions, or insufficient bookings. In such cases, we will offer an alternative tour of equal value or a full refund. We are not liable for any additional costs incurred such as flights or visas.
6. Travel Insurance
Travel insurance is compulsory for all clients. Your policy must cover trip cancellation, medical expenses, emergency evacuation, and personal liability. We strongly recommend purchasing your policy at the time of booking. We are not responsible for any costs arising from a lack of adequate travel insurance.
7. Itinerary Changes
While we endeavour to operate all tours as advertised, itineraries are subject to change due to weather, road conditions, wildlife activity, or other unforeseen circumstances. Any changes will be communicated as early as possible. No refunds will be given for itinerary modifications outside our control.
8. Prices
All prices are quoted in US Dollars unless otherwise stated and are subject to change without notice until a booking is confirmed. Once confirmed, prices are guaranteed except in cases of government-imposed tax changes or currency fluctuations exceeding 10%.
9. Inclusions & Exclusions
Each tour package clearly states what is included and excluded. Clients are responsible for all items listed as excluded, including but not limited to visas, tips, personal items, and optional activities.
10. Health & Fitness
Clients are responsible for ensuring they are in adequate health to participate in their chosen tour. Please inform us of any medical conditions, dietary requirements, or physical limitations at the time of booking. We reserve the right to exclude any client from an activity if we believe their participation poses a risk to themselves or others.
11. Vaccinations & Entry Requirements
Clients are solely responsible for obtaining all required vaccinations, visas, and travel documents for Kenya, Tanzania, or any other destination included in their tour. We are not liable for any costs or consequences arising from failure to meet entry requirements.
12. Conduct
We reserve the right to terminate the participation of any client whose behaviour is deemed disruptive, dangerous, or offensive to other clients, staff, or local communities. No refund will be issued in such cases.
13. Wildlife & Safety
All wildlife encounters involve inherent risks. Clients must follow the instructions of their guide at all times. We are not liable for any injury, loss, or damage arising from wildlife encounters, game drives, bush walks, boat rides, or any other safari activity.
14. Liability
To the fullest extent permitted by law, we are not liable for any loss, injury, damage, delay, or inconvenience caused by circumstances beyond our control, including acts of God, government actions, strikes, or third-party service providers such as hotels, airlines, and park authorities.
15. Privacy Policy
We are committed to protecting your personal information. Any data collected during the booking process is used solely for the purpose of administering your tour and will not be shared with third parties without your consent, except where required by law.
16. Governing Law
These terms and conditions are governed by the laws of Kenya. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.
